Contents
In short: Your notes are private and yours. Don't use Noteshik to store or share anything illegal, abusive, infringing, or harmful. Child sexual abuse material is reported to the National Center for Missing & Exploited Children (NCMEC). We act on reports, remove content that breaks these rules, and close accounts that break them seriously or repeatedly.
1. Scope
This Acceptable Use Policy ("AUP") applies to everyone who uses Noteshik on any surface: the web app at noteshik.app, the Android, Amazon Fire and any other mobile apps, the browser clipper, shared note links, imports, and the API. It covers everything you store, upload, import, sync, transcribe, extract, or share through Noteshik ("your content").
This AUP is part of our Terms of Service. By creating an account or using Noteshik you agree to it. Our Privacy Policy explains how we handle personal data, including data we process when we investigate a report.
2. Prohibited Content
You may not use Noteshik to store, upload, share, or distribute:
Illegal material
- Anything that is illegal where you are, or illegal under the laws that apply to us or to our hosting locations.
- Content that promotes, plans, or facilitates a crime, including fraud, scams, trafficking, the sale of illegal goods, or terrorism.
- Personal data about other people (for example ID numbers, financial account details, or medical records) that you have no lawful right to hold or share.
Child sexual abuse material
- Any content that sexually exploits or endangers minors. See Section 3. There are no exceptions.
Copyright and other intellectual property infringement
- Content that infringes someone else's copyright, trademark, or other rights, including using shared links to distribute pirated books, courses, software, or media.
Hate, abuse and harassment
- Content that attacks or dehumanises people based on race, ethnicity, national origin, religion, caste, sex, gender identity, sexual orientation, disability, age, or serious illness.
- Threats of violence, incitement to violence, or glorification of violent attacks.
- Harassment, bullying, stalking, or publishing someone's private information to target them ("doxxing").
- Sexual images of a real person shared without their consent, including altered or AI-generated images.
Malware and deceptive content
- Viruses, ransomware, spyware, exploit code aimed at systems you are not authorised to test, or links to them.
- Phishing pages, fake login forms, or content that impersonates Noteshik, another company, or another person to deceive.
- Spam, including using shared links to mass-advertise or to drive traffic to scams.
3. Child Safety (CSAM)
We have zero tolerance for child sexual abuse material (CSAM) and for any content that sexualises minors.
- When we become aware of apparent CSAM, we report it to the NCMEC CyberTipline, as United States law requires of online service providers (18 U.S.C. § 2258A), and to other law enforcement authorities where the law requires or allows it.
- We remove access to the content, close the account immediately without notice, and preserve the content and related account information for as long as the law requires so that law enforcement can use it.
- We do not restore accounts closed for CSAM, and the appeal process in Section 10 does not apply.
If you come across CSAM: do not download, copy, screenshot, or send the material to anyone, including us. Report it directly to NCMEC at report.cybertip.org (or your local police), and email us only the shared link or note address at support@9gg.app with the subject "Child safety report". If a child is in immediate danger, call your local emergency number.
4. Security & Platform Abuse
You may not:
- Access, or try to access, another person's account, notes, or data without permission.
- Probe, scan, or test the security of Noteshik without our written permission. Report vulnerabilities through our Security page instead.
- Overload, disrupt, or attack the service, including denial-of-service attacks, flooding the API, or bypassing rate limits.
- Scrape, crawl, or harvest data from Noteshik or from other users' shared links with automated tools.
- Reverse-engineer, decompile, or tamper with the apps or API, except where the law expressly allows it.
- Get around plan limits, feature gates, or payment, for example by creating multiple accounts, sharing a paid account, or manipulating the apps.
- Create an account to evade a suspension or termination.
- Use Noteshik's AI features (voice transcription, photo text extraction and similar) on material you have no right to use, or to produce any content this AUP prohibits.
5. Your Obligations
When you use Noteshik, you agree to:
- Only store and share content you own or have the right to use.
- Follow the laws that apply to you, including copyright, privacy, and data-protection laws.
- Keep your login details secret, and tell us straight away if you think someone else has used your account. You are responsible for activity on your account.
- Treat every shared link as public. Anyone with the link can see that note, so what you share must meet this AUP.
- Keep your account information accurate and meet the minimum age in our Terms.
- Respond truthfully if we contact you about a report or a possible violation.
- Keep your own backup of important notes. If we remove content or close an account under this AUP, we are not obliged to return content that breaks it.
6. Moderation & Takedown
Notes are private by default. We do not monitor or routinely read private notes. We look at content only when we need to, for example:
- when we receive a report about a shared link or an account;
- when we receive a copyright notice, a court order, or another legal request;
- when automated signals (such as abnormal traffic, rate-limit abuse, or malware detection) point to a security problem;
- when you ask us to, for example in a support request.
If we believe content or activity breaks this AUP, our Terms, or the law, we may, at our discretion and without first asking you:
- remove or disable access to the content, or disable a shared link;
- restrict features such as sharing, uploads, imports, or AI features;
- suspend or close the account (see Section 9);
- preserve content and account information, and share it with law enforcement or other authorities when the law requires it or when it is needed to protect someone's safety.
We are not required to host any particular content. Not acting on a violation does not waive our right to act on it later.
7. Reporting Abuse
Anyone can report content or behaviour that breaks this AUP, with or without a Noteshik account.
How to report: email support@9gg.app with the subject "Abuse report", or use our contact form. Please include:
- the shared link, note address, or account email involved;
- what the problem is and which part of this AUP it breaks;
- your contact email, so we can follow up (reports can be anonymous, but then we cannot update you).
We review reports as quickly as we can and give priority to child safety, credible threats of violence, and malware. If you are in the European Union, you can use the same address to notify us of illegal content. Please do not send reports you know are false; misuse of the reporting process can itself lead to account action.
For copyright infringement, use the notice process in Section 8. For child sexual abuse material, follow Section 3.
8. Copyright & DMCA
We respect intellectual property rights and respond to notices of alleged infringement under the U.S. Digital Millennium Copyright Act ("DMCA", 17 U.S.C. § 512) and similar laws.
Sending a takedown notice
If you believe content on Noteshik (usually a shared link) infringes your copyright, send a written notice to support@9gg.app with the subject "DMCA Notice". Your notice must include:
- your physical or electronic signature (or that of the person authorised to act for the copyright owner);
- identification of the copyrighted work you say is infringed;
- the exact location of the infringing material, such as the shared link, detailed enough for us to find it;
- your name, postal address, telephone number, and email address;
- a statement that you have a good-faith belief that the use is not authorised by the copyright owner, its agent, or the law;
- a statement that the information in the notice is accurate and, under penalty of perjury, that you are the copyright owner or authorised to act on the owner's behalf.
We will remove or disable access to the material identified in a valid notice and let the affected user know.
Counter-notice
If your content was removed and you believe that was a mistake or that you have the right to use it, you may send a counter-notice to the same address with the subject "DMCA Counter-Notice". It must include: your physical or electronic signature; identification of the removed material and where it appeared before removal; a statement under penalty of perjury that you have a good-faith belief it was removed by mistake or misidentification; and your name, address, and telephone number, with a statement that you consent to the jurisdiction of the federal district court for your address (or, if you are outside the United States, any judicial district in which we may be found) and will accept service of process from the person who sent the original notice.
We forward valid counter-notices to the original complainant. Unless they tell us within 10 business days that they have filed a court action, we may restore the material 10 to 14 business days after receiving the counter-notice.
Repeat infringers
We close, in appropriate circumstances, the accounts of users who are the subject of repeated valid infringement notices.
False claims
Under 17 U.S.C. § 512(f), anyone who knowingly misrepresents that material is infringing, or that it was removed by mistake, may be liable for damages. If you are unsure whether content infringes your rights, consider getting legal advice before sending a notice.
9. Enforcement & Account Termination
What we do depends on how serious the violation is, whether it was intentional, and whether it has happened before. Our response can include:
- A warning and a request to remove the content.
- Removing content or disabling shared links.
- Restricting features on the account.
- Temporary suspension of the account.
- Permanent termination of the account.
For most violations we will first contact you and give you a chance to fix the problem. We close accounts immediately and without notice for severe violations, including child sexual abuse material, credible threats of violence, active attacks on Noteshik or its users, distributing malware or phishing, repeat copyright infringement, or creating an account to evade an earlier termination.
When an account is terminated:
- you lose access to the account, its notes, and any shared links straight away;
- your data is deleted on the schedule in our Terms and Privacy Policy, except where we must keep it for legal reasons (for example after a report to NCMEC or a law enforcement request);
- you may not create a new account without our written permission;
- termination for a violation does not entitle you to a refund of any subscription fee, except where the law or the rules of the app store you paid through require one. Cancel any app-store subscription through that store.
You can close your own account at any time at noteshik.app/delete-account.
10. Appeals
If you think we removed content or restricted, suspended, or closed your account by mistake, email support@9gg.app with the subject "Appeal" within 30 days of our action. Tell us your account email, what happened, and why you think the decision was wrong. A person will review the appeal and we will tell you the outcome. Appeals are not available for accounts closed for child sexual abuse material, or where the law prevents us from reversing or discussing the action. Copyright removals are handled through the counter-notice process in Section 8. Nothing here limits any right you have under the law where you live.
11. Changes & Contact
We may update this AUP to respond to new kinds of abuse, legal requirements, or changes in Noteshik. We will update the date at the top of this page and, for material changes, notify you by email or in the app before they take effect, as described in our Terms. Continuing to use Noteshik after changes take effect means you accept the updated AUP.
Questions about this policy: support@9gg.app or our contact form.
